Terms of Service

Welcome to CacaoX. These Terms of Service ("Terms") govern your use of the CacaoX mobile application and related services (collectively, the "Service") provided by CacaoX ("we," "us," or "our").

1. Account Registration

To use CacaoX, you must:

• Be at least 13 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account access
• Accept responsibility for all activities under your account

2. Acceptable Use

You agree to use CacaoX only for lawful purposes. You may not:

• Use the Service to violate any applicable laws or regulations
• Attempt to gain unauthorized access to the Service or other accounts
• Interfere with or disrupt the Service or servers
• Upload malicious code, viruses, or harmful content
• Collect user information without consent
• Use the Service for any commercial purpose without our permission
• Impersonate any person or entity

3. Your Content and Data

You retain ownership of the data you enter into CacaoX, including:

• Farm information and settings
• Tree records and profiles
• Harvest logs and activity records
• Photos and images you upload

By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.

4. Farm Collaboration

When you invite others to your farm:

• You control what role and permissions each member has
• You are responsible for the actions of users you invite
• Farm members can access and modify farm data based on their assigned role
• You can remove members or revoke access at any time

5. Subscription and Billing

CacaoX offers a free trial period and paid subscription tiers:

• Free Trial: 30-day trial with full feature access and one farm limit
• Subscription: Continued access after trial requires an active subscription
• Billing: Subscriptions are billed through the Apple App Store
• Cancellation: You may cancel your subscription at any time through your App Store settings

After trial expiration without subscription, your account enters read-only mode where you can view but not modify data.

6. Service Availability

We strive to provide reliable service, but:

• We do not guarantee uninterrupted or error-free service
• We may modify, suspend, or discontinue features with notice
• Scheduled maintenance may temporarily affect availability
• We are not liable for any loss due to service interruptions

7. Intellectual Property

The CacaoX application, including its design, features, and content, is protected by intellectual property laws. You may not:

• Copy, modify, or distribute our software
• Reverse engineer or decompile the application
• Use our trademarks without permission
• Create derivative works based on the Service

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will meet your specific requirements
• The Service will be uninterrupted, secure, or error-free
• Results from using the Service will be accurate or reliable
• Agricultural recommendations will result in improved yields

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CACAOX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Service interruption or data loss
• Cost of substitute services
• Any damages arising from your use of the Service

10. Indemnification

You agree to indemnify and hold harmless CacaoX and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Fail to pay applicable subscription fees
• Abuse the Service or other users

You may terminate your account at any time by contacting support. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Sending a notification through the app
• Emailing you if significant changes are made

Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Puerto Rico, United States, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through informal negotiation. If unresolved after 30 days, disputes may be submitted to binding arbitration.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CacaoX regarding the Service.
